LOCAL LAW PROHIBITING GLASS OR GLASS CONTAINERS ON BEACHES

Legislative Intent: By adoption of this local law, the Town Board of the Town of Hanover declares its intent to prohibit or regulate use of glass, or glass containers, on the beaches within the town in a manner consistent with the health, welfare and safety of its citizens. Therefore, in this exercise of its police power vested in it under Section 130 of the Town Law of the State of New York, the town board does hereby enact the following local law:


ARTICLE I- APPLICATION

Section 1. This local law shall apply to all public, private or semi-private beaches within the Town.

ARTICLE II- GLASS PROHIBITED

Section 2. No person shall throw, deposit, carry, use or break any glass bottle, container, jug, jar or glass of any kind, over or on the beaches within the Town.

ARTICLE III- VIOLATION OF LOCAL LAW: PENALTY

Section 3. Any violation of any section of this local law shall be declared an offense and upon conviction a person shall be subject to a fine of not more than fifty-dollar ($50.00) or ten (10) days imprisonment or both.

Section 4. In addition to the above provided penalties and punishment, the Town Board may also maintain an action or proceeding in the name of the Town in a court of competent jurisdiction to compel compliance with, or to restrain by injunction to the violation of this local law.

ARTICLE IV- SAVING CLAUSE

Section 5. If any clause, sentence, paragraph, section or part of this local law shall be adjudged invalid by any court of competent jurisdiction, such judgement shall not affect, impair or invalidate the remainder.

ARTICLE V- EFFECTIVE DATE

Section 6.  This local law has been duly adopted by the Town Board of the Town of Hanover at its regular meeting of May 8, 1967 and shall take effect immediately.
