The ZBA was called to order by Acting Chairman K. Waterman at 7:00 pm in the Code Enforcement Office. All members present except A. Logan and R. Erdle. Also present were three town offficials and six community residents. It was moved by W. Kraft and seconded by V. DeJohn to approve the minutes of the previous meeting as read. All members voting aye. Motion carried.
It was moved by V. DeJohn and seconded by W. Kraft to open the public hearing. All members voting aye. Motion carried. The public notice for the variance request by James and Shirley Shevlin was read by Acting Chairman K. Waterman. J. Shevlin explained his need for the variance. He would like to open an auto repair shop in the former restaurant on Rte.5 and continue to rent the storage facility. He indicated that all auto storage would be on a day to day basis and that he would use the garage located on the back of the property. The existing restaurant would be office space. M. Steiger, Mr. Shevlin's realtor, spoke about the property and explained the proposal for the use of the property. The Shevlins would use the existing driveway and signage. The storage area is already within the zoning specifications of the property so the variance would be for the auto repair shop only. A letter from Chautauqua County indicated that this is a matter of local concern and they had no objections. There was no public opposition to the plan. It was moved by V. DeJohn and seconded by W. Kraft to approve a special use variance permit to operate an automobile repair shop with the stipulations that vehicles being left overnight be stored behind the building and there be no unlicensed vehicles for sale. The deminsions of any signage must be approved by the Code Enforcement Officer. All members voting aye. Motion carried. It was moved by W. Kraft and seconded by V. DeJohn to adjourn. All members voting aye. Motion carried.
